Statement of Claim
Claimant says:
"I hired them to move my family back in March of this year. They dropped my 42" television on the sidewalk and were nice enought to tell me. It is dented in the front, split on the side and leans three inches forward which is not normal. I have put a claim in to their company for the insurance to replace the tv, I have written a letter to them to speed up the process and my wife and I have gone over to the business and met with the owner and were assured the television would be replaced. It has been 6 months and not one thing has been done to satisfy us or replace the tv. The company is insured ,that is why we chose them in the first place from a referral. I need some help with this issue instead of me having to hire an attorney just to get my merchandise replaced. I do not want anything else except my tv put back the way it was originally. Thanks for your concern. Please let me know what you suggest going forward with this complaint."

  • On Mr. Matthews' visual estimate, Mr. Neely stated that he was going to move everything including his flat screen TV's. We would be responsible for the heavy items only. On his move day, Mr. Neely signed a waiver giving us permission to move unpacked items such as TVs, mirrors, glass, etc. but we would not be responsible for any damage to those unpacked items. Had Mr. Matthews known at the time of the visual estimate that we would be responsible for moving his flat screen TVs, he would have noted it on the estimate and the proper packing materials would have been sent on his move day. Moving companies are regulated by The North Carolina Utilities Commission and they provide us with guidelines and regulations by which we must abide. We have three different types of valuation to insure against damage. The first option is Basic Valuation Protection, which is free of charge to the customer and pays $0.60 per pound per article, which Mr. Neely chose. The second option is Depreciation Value Protection and the third option is Full Value Protection. Both the second and third types of valuation would have been additional charges to the customer. We have scanned and attached the appropriate paper work which shows the valuation that he chose as well as the waiver he signed regarding unpacked items. The weight of the TV by itself is approximately 28 pounds which would equate to $16.80 that we are required to reimburse Mr. Neely. The claim of $3,252.90 is outrageous and totally unacceptable especially since the Statement of Claim form we received from Mr. Neely stated the TV was two (2) years old and cost approximately $900.00. They are making a ridiculously exaggerated claim and based upon our research, one can purchase the same TV brand new for $498.00. We will not pay the $3,252.90 and will offer to pay the amount required by the Basic Valuation of $16.80.

  • Mr. Matthews told me he would move the tv in a box. I am not aware of any waiver I signed to take responsibility for tv's or anything unpacked only the heavy things. We used this company since they have a reputation in Charlotte supposedly and they have insurance in case of damage. I do not want anything but my tv paid for. I tried to get him to replace the tv but it has taken him 6 months to get the problem resolved so we would rather be paid for the tv and we will take care of it ourselves. It has been IGNORED long enough and he has to agree with that totally. If the mover had not told us he dropped the tv in the first place we would never be in this situation at all. Thank GOD for some honest people.
