Statement of Claim
Claimant says:
"Let me start from the beginning. I had some unauthorized charges come through on my account so I went up to the bank to fill out paper work on disputing the charges. Because these charges came through my account unauthorized it overdrafted my account not just once but 3 times. The amount in which was disputed was returned promtly to my account. I want to also add that I never spoke to the lady in charge of these types of disputes but rather the teller, who was very helpful, had to keep running back to ask her questions. Anyway I filled the paperwork out and the teller told me it would be later in the day when they would return the money to my account because the lady in charge of the disputing had a lot of items on her plate to take of. So I went home. I checked my account two hours later and saw the money was in there. Yay! but wait my account was still overdrafted...She had only refunded the amounts that I disputed not the overdraft fees that came with it. I called the bank immediately and spoke to the same teller I had talked to earlier. She says Yes they should return those fees BUT the lady in charge of disputes had left for the day...This was around 2:00 pm. I said I have 3 items coming through my account I have the money to cover it should I put it in? No wait until you talk to her directly we would not want the overdraft fees to eat up the money you put in but she will leave her a note and have her call me. The next day rolls around and I didn't get a call. So I called and left her a message after obtaining her direct line. I did not hear anything for a few hours so I went into the bank. It was around 1:00 pm. What do you know she was gone for the day. So I asked the teller. What do I do? Again I say I have 3 things coming through my account but because it is still overdrafted, because I could not get ahold of this lady to refund it, which she should have done to begin with apparently the money I put into the account wont be enough to cover what is coming through. The teller says Oh well I would not put the money in until AFTER you talk to the lady in charge of this department, let me give you her direct line. I explain I already have the number and I had called. She again apologized and said she would personally email her. The next day I look at my account and what do know on of the items I said would come through came through. I call the bank leave a message for the overdraft lady again and call back and talk to the same teller. She tells me she will personally monitor my account and watch it. So I finally get a call back from this overdraft lady does credit me the overdraft fee back awesome. So I get on to look at my account and what do know the other two items come through I now have three more beautiful fees charged to me. I call back overdraft lady guess what.. No answer I leave a message. I go back to the bank...you guessed it she's already left for the day. I get another call back the next day saying her supervisor will not approve the other three overdraft fees to be refunded. I say okay can I speak to your supervisor. guess what she had left for a meeting I was told but she would be back shortly, then I was told she would leave a message for her. I told her I would be up there on my lunch break at 12. I go up to the bank at 12 and ask for this supervisor. So they bring out dispute lady this is the first time I actually speak to her in person. She says I am sorry there is nothing I can do my hands are tied I say where is the supervisor. Oh she left for the day...right!? Seriously I say is there no one here I can speak to about this?? No I am sorry here is her direct line. I call supervisor her name was Julie. I leave her a message. no response till the next day which is saturday. So this started on Monday here we are at Saturday. I call her again saturday morning I was also told that the overdraft lady would email her and explain my situation. She calls and leaves a very casual message of I would love to sit down with you about your account we cannot refund the money but if you like you can come in and talk to me. I call her back no answer I leave a message explain the whole situation again... also adding my husband and I are college students with a two year old $90 in overdraft fees is a lot for us please understand I was told on two different visits into the bank that I was advised NOT to put money into the account until it was resolved I tell her I will be in on my lunch break. I go in and guess what...she had left for the day.. At his point I am so heated. I feel like I have been avoided and because my account does not always contain high amounts of money I am brushed under the rug. I am also thinking seriously why are these supervisors only working half days?! And can you seriously tell me no other person in that bank could refund overdraft fees? I have gone out of my way while dragging my crazy two year old into the bank on 4 different occasions to try and resolve this. I am completely fed up and will be closing my account. I normally try to stay off the radar with these types of situations but when I saw Cherokee Strip had and A+ rating for outstanding customer service it made me sick and I had to tell my story. I do want to add that the tellers were very nice it's their management that needs work. Being a manager myself at a retail business I could not believe the lack of response and respect. Seriously..a WEEK before I get to talk to this supervisor and still no resolution!"
