Statement of Claim
Claimant says:
"Last March 21, 2013 I loaned a commercial truck 2006 International 4300 to Carmenita Truck Center. By May 21, 2013 the truck was broken down and return it to Carmenita Truck Center. I received a call to them that all fuel injector was malfunctioned, they promised to me that they going to give me a replacement truck, but until today July 08, 2013 I didn't have the replacement truck they promised. I lost a lot of income for this matter and I didn't pay my other bill for lack of income. I would like to refund the money I used for the down payment and I would like the Carmenita Truck Center to pay me a one month damages equivalent to my monthly income."

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "Mr Yutuc purchased a truck from us and then proceeded to drive said truck with "check engine" lights on for an extended period of time. He was advised by our service dept that the truck needed service and refused (all of this is highly documented). Once the truck no longer ran correctly he brought it in for repairs. We advised of the repairs and he couldn't afford them. Going FAR ABOVE AND BEYOND the level of customer service needed, we offered to help put him in a different truck, AT NO COST TO HIM. We invested tens of thousands of dollars finding a different chassis and a better brand, invested thousands having his box put on this chassis and rehab'd his lift gate (again, at no cost to him), negotiated with his finance company to freeze his payments, even though he had missed payments, worked with the finance co. to to a swap from the old unit he errantly drove with with check engine lights on, thus causing damage to his other truck, and then presented him this much better option in the name of outstanding customer service. If Mr. Yutuc so choose and opts to take this route, we will have no choice but to transfer this claim to our legal department, rescind the offer of a better truck and let the finance company request reposession of his old unit."
