Statement of Claim
Claimant says:
"On 17 July 2013,I entered the above business looking to trade a 2010 Mercedes E-350 I'm a senior citizen and also a disabled vet with back and knee problems and the Mercedes was getting harder for me to exit. The car belonged to my wife but she is also having medical issues- long story short I was driving the car more than she would ever be able to so we decided to trade it for a larger vehicle with more room for me to drive comfortably. I found a 2010 Cadillac SRX that would provide me with the extra room and decided to trade it . They inspected my car and valued it at $30.000 my car was financed with USAA and the Cadillac would also be financed with USAA. USAA had already given me the green light for the financing on what ever I find . I test drove the Cadillac and liked the test drive so we did paper work that evening late and I took the car home that evening it was dark so I waited until the next day to really look the car over. I found two new tires on the front and two old tires on the back (I'm alert now for front end trouble) I then looked for the spare but could not find it I called the dealership to explain the tire problem and was told I would need to speak to the manager but he was out and would return later I wanted to speak to him on the phone hoping that we could make some arrangements for the tires, after waiting for hours I never received a call at around 2:30 P.M I drove the car back to the lot and inquired to sales people about the tire and jack problems. I was finally told that that particular car did not come with a spare and it had a can of fix a flat if it was ever needed my question was what if I had a blow out with a hole too large for the fix a flat? - I was told the manufacture was trying to make the car lighter ect,ect. I left the car at the dealership after receiving the return paperwork I signed the documents without really noticing any details because I thought it was just paper work stating I returned the car I was not concerned because they had the car back- deal closed!
I came home and looked at CarMax on line products and found a 2013 Chrysler 300C but it was in Austin,I talked to a salesman and he arranged for the car to be shipped to San Antonio without charge, in a couple of days the car was on the lot I test drove it liked it and decided to make the deal- financed with USAA and all approvals I brought my present car home I was and still happy with this car. About the second week in August I received a call from one of the administrative people in the office informing me that I owed $3,515.15 for negative equity in the Cadillac I told her I did not purchase this vehicle and the reason why but she insisted I still owed the funds I told her I kept this car over night returned it the next day and they made a mistake. I asked how could I owe any thing on this car when I did not have it for 24 hours she tried to explain some out of space seniro so we departed this conversation because I will not pay to any one ripping me off. A few days later I received call from cooperate I told them and wrote to them about where I stand. I cannot summerise how I could owe them any thing when USAA was going to fund this car if I had kept it and since I did not keep it not even 24 hours how could they charge me any amount of money for anything? USAA had set up the account and they sent me the close out for returning the car. I have informed them that I will pass this information to my DAV chapter, American Legion, and church groups so they can be on the alert about possible deals like this. My question for you is this how can they work this or how is it suppose to to work and why are they saying I have negative equity on a car I do not own or purchase.? It sounds very fishy to me, I cannot see where I owe them anything and will not pay I have excellent credit over 725 that proves I pay what I owe if I owe it this is insane and very fishey at the least."

  • After receiving a couple of call early 2014,I yet refuse to pay any amount of money it's October 2014 ,and I have not heard from them . Since there is no communication I don't know what to think , makes me no difference because they will never get any amount of money from me for a rip off like this. I consider it short of racketeering.
