Statement of Claim
Claimant says:
"Failure to reimburse me for the cost to replace a pump in my spa. The spa was under warranty so I requested a new pump. I was told to take the pump out and sent to Cal Spa. Two problems, no one in Utah would service Calif Spas, secondly it was still March in Utah and I could not just take the pump out and leave spa unprotected from the cold and potential of frozen. So I purchased the pump, had someone in Uth install, sent out pump to California Spas. After waiting a reasonable amount of time, I called Calif Spas after numerous phone calls, that went unreturned finally I got someone at Cal Spas. I have still not received my check from Cal Spas to pay for the pump that I purchased, which has been going on since March of 2010. I was told by John Nelson that I would have a check by the end of the week of Sept 13. To this date I have stilled received nothing, seeking reimbursement in the amount of $789.19."

  • 03-11-2008 — Faxed Copy of Warranty information to Elaine Ville, Cal SPA with claims request.
  • 03-18-2008 — Faxed same information second time
  • 03-19-2008 — Given ok on claim request form to have pump replaced because Cal Spas had no one to represent them in Utah. Told to have pump removed and returned to Cal SPA for reimbursement.
  • 04-07-2008 — Certain Bath and SPA obtained pump and replaced in Spa at a cost of 693.02, also had service call on 3-9-2010 ti determine that problem.
  • 04-14-2008 — Defective pump returned to Cal SPAS
  • 04-16-2008 — Called Elaine, they had received pump, indicated would be 6-8 weeks, but she had already ordered check so should be less time.
  • 05-14-2009 — Called claims they indicated they had not had time to process, faxed billed again to Elaine she indicated she would cut me a check. Have called Elaine for 3 days straight without a return call.
  • 05-20-2009 — Never received check so filed case with the Better Business Bureau who contacted Cal SPAS.
  • 06-03-2010 — At this time Cal SPAS wanted proof of transaction either check or credit card. Invoices had already been sent to Elaine and this is the first I have heard of verification. I requested verifcation of my credit card transaction and furnish to Elaine at Cal SPAS. Cal SPAS failed to reply to the final request from the better Business Bureau on 6-16. Contacted Elaine again she said now 6-8 weeks because they didn't have all information before. I guess the check had not been order then. Gave Cal SPAS 2 additional weeks to responded per BBB. Nothing! Started calling Elaine finally reached her on 8-27, she indicated accounting really busy and can't get check out until the end of Sept. Said this will not work and asked to speak to her supervisor. She gave me the name John Nelson over maintenance/Warranty. Called John from 8-30 to 9-3 finally got him as he had not returned my calls. John apologized for delay and indicated I would have my check by 9-10-2010. Well as of today still no check, don't know what to do other than get something like this out there.
