Statement of Claim
Claimant says:
"Kristina at promised a transmission repair not to exceed $1,597.00. She stated that she controlled the price because she sends the parts and the repair would be complete in one or two days. She had my truck towed to a transmission repair facility and later that day Kristina sent me an email with a contract and an invoice for $297.00 as a deposit which would be applied to the repair. Although their contract did not state it, the owner Kristina verbally stated that it would be a remanufactured transmission "As good or better than new", complete with a one year unlimited mileage warranty. Kristina left me a voicemail and said no work could start until I sent her the $297.00 deposit using PayPal.

The transmission shop she sent us to removed the trasmission per her instruction and waited for the new one to arrive (which should have been the next day). After many unanswered phone calls from me and the transmission shop, she finally got back to transmission shop and said she was tracking the transmission and would have more info soon. Then (after my truck being at the shop for five days) I received an email message from Kristina that I should call a number and give someone named Ramone my credit card info. When I contacted Ramone it turns out that he has a wrecking yard and was contacted by Kristina at and had a used transmission waiting for payment. Ramone wanted $1,150 plus freight from Bakersfield (a couple hundred miles away). I was not aware that we would be dealing with (paying) another third party for the actual transmission...The transmission shop needed $540.00 for the removal and replacement of the transmission, plus the $297.00 already paid to, the price was now way over the guaranteed price, plus it was just a used transmission. On Monday June 11, 2012 I had enough. I asked Kristina for a refund. Two days later she replied by email with some bogus excuses, including that she was just a referral company. She offered $125.00 refund (which was never received). I have left several voicemails since, without any response."
