Unfair double billing practices by Autocom Nissan of Concord. Refusal to correct problem. I need help!

Statement of Claim
Claimant says:
"I purchased a 2013 Infiniti 12/13/2015 from Nissan Autocom. In January of 2016, I went to my credit union to obtain a loan for the down payment. Instead. my credit union paid off my loan. Since then, Nissan has been billing me for this car. I have called them several times to explain that my loan has been paid off, in full; but, they continue to send invoices and make threatening phone calls saying that my payments are delinquent and continue making aggressive and argumentative calls to my home phone @08:30 am on week ends. I told them it was unfair to me since I am making double payments to two different agencies for the same car. My statements have been ignored. I have talked to my loan officer @ my credit union. They say that they don't understand why Nissan Autocom is behaving in this manner."

  • I spoke to a Kamal of Autocom Nissan of Concord. I called personally to your customer service department and that is when I received very verbally abusive and aggressive treatment. I applied to my credit union in December of 2015 and the credit union advised you they were financing my loan, but you sent the paperwork through anyway. I placed a stop payment on my check for the down payment because I had my loan through my credit union.

    I believe this situation was due to miscommunication between you, your credit union, and us. First, during the purchase process, there was no mention of you financing through your credit union. Second, by the time your credit union send us the check, it has passed 2 weeks and the loan has been submitted and finalized by Nissan Motor Finance Acceptance as well as all necessary DMV paper work. Finally, your credit union only send us the check less than the down payment, which you have cancel. Therefore, it was not sufficiently satisfy your finance obligation for the contract since you stop payment on the down payment. It was not until February, that you have made good on your $5000 down payment. At this point, since the loan has been place with Nissan Finance, I think you need to communicate with your credit union, if you still want to finance with them, then they can go ahead and paid Nissan finance off. Which ultimately resolve this situation. Again, I apologize for any misunderstanding and thank you for your business.

  • I went to my credit union initially to obtain the 5000 down payment. As your agency knows well, my credit union decided to fund the entire loan and not just the down payment. I went again to my credit union and obtained the payoff amount from Nissan Motor Acceptance Corporation, PO Box 78132. Phoenix, Az 85062. The credit union representative phoned your loan department with my permission and together we spoke to your agent who gave us the address to mail the payoff overnight. Since them, you continue to send invoices for payment which I do not undertsand

    Again, originally you did went to your credit union to obtain the loan after couple of week from the purchase. However, the check they sent to us was without your $5000 down payment. Therefore, we have since sent back the amount of the check your credit union issue to us. As for the pay off to Nissan Motor Acceptance, they are separate entity from our dealership. it is between your credit union and NMAC. if you can reach out to your credit union obtaining the proof of the pay off to NMAC with date and amount, I will be glad to help you sort this out with NMAC. Since your finance obligation to our dealership has been fulfilled, I see no reason for us to send you invoice, and we do not send invoice for payment, NMAC does. There is a phone number on the invoice for NMAC, you can also inquire about the pay off and the reason for their continue solicitation of payment if your loan was paid off by your credit union.
