"I agree with Anthony DeLucia but would add that patient needs to return with a new set of dentures before getting the full refund. Some people just can not be made happy with dentures so not the dentist fault at all. The rest of the requests are foolish."

"Since I have no information about the treatment or attempts to address this concern(s) I cannot agree (or disagree) with the claim except for the claim of $400 for patient time. Patients do not get reimbursed for their time as they are not charged for their time and the dentist does not charge for his/her time, specifically. (as an attorney would)."

    Almost 18 months out without resolution is a sad situation for both parties. Not enough information available from both to clearly suggest a resolution that could satisfy both. I agree with others comments...life is frankly too short and a dispute like this can eat up time, resources and daily happiness and satisfaction for all. The vast majority of doctors are ethical and most patients are willing to allow them to use their training and skill to resolve a situation. Some personality conflicts or hurt feelings at this point make it more complicated. You would hope the doctor has done all they can including possible relines/remakes and a sit down discussion about what an acceptable outcome is (also, patient claims damages- if there are, have they been addressed?) and if the patient has allowed all reasonable attempts to satisfy be exhausted...at this point, just refund the patients money. Contribute to repairing and damages if any. Try NOT to depart as enemies.

    This is very simple to resolve especially for such a small amount of money. Just refund the patient his out of pocket expense($2288.00). If insurance is involved, whatever the insurance reimbursement was must be returned to the insurance company. The patient is not entitled to anything further. I have been in solo practice for 30 years and not every one can be satisfied. Sometimes a case may not go well. Get a signed release with notary, refund patient his money, learn from any mistake you made and move on.

    Not knowing more details of this case it is not possible to suggest a remidy. Were the teeth full dentures, partial dentures,fixed bridges,implant supported crowns or bridges?

    Was this for a denture or dental work? Or is the patient complaining of her own teeth not fitting together well? If dental work was done and the teeth do not fit together, many things need to be addressed. TMJ? Pain, history of other dental work, sleep issues, grinding. There is simply not enough information.

  • Dentistry is not always easy -- some patients present all sorts of complications that require a lot of effort to work through.   Not sure what is going on here from the limited info, but the proposed resolution has several issues :

    Paying the patient for a difficult case may just promote them to make things more difficult for the reward they might get.  

    If the pt was paid thru insurance, any refund must be split between the carrier and patient.  Generally, it's also common practice to not refund the patient until the work has been completed at another office, at which time the patient and carrier would be expected to pay for the care.  Any additional cost for care at another office is the patient's responsibility.

  • it sounds like the pt is unhappy with his dentures.   If he was not  informed ahead of time of a difficult and /or unusual problem, then refund the pt his monies and move on.

  • To help in this dispute I would need more information including photos of the dental work, copy of patient chart and copy of x-rays as a minimum.  The patients complaint may be justified but impossible to make a determination without further evidence.

    If the dentist involved is a member of the local Dental Society, the patient may choose to go through their Peer Review system to see, in fact, if their complaint is valid, and if any refund is in order for treatment below the standard of care.
