Claimant's opinion: Recently, my wife's 4GB APPLE IPOD NANO, while playing suddenly exploded and caught fire on my wife's desk at work, almost burning her hand as she had to toss on the floor, also damaging her office carpet, before be able to extinguish the flames. (Please see Pics attached). The local Better Business Bureau, and Consumer Affairs office advised us to try & work out directly with Apple Corp first before proceeding further.
Elizabeth Johns is correct. Apple can't really make an offer until they find out what made your ipod catch fire. Your claim is basically about two fears:
Fear #1) Your evidence will disappear. Ms. Johns has made some very good suggestions about how to ensure that this doesn't happen. In addition I recommend that when you do send the iPod to Apple, you send it with tracking and keep a copy of the tracking number. Take a picture if you don't have a copy machine, or print out two labels. Don't just put it in a drop box. Make sure it is scanned in by the post office, UPS, Fedex or DHL, and get a receipt.
Fear #2) You will leave money on the table if you don't know what to ask for. The answer to this is to get the offer first and see whether you're happy with it or whether you need someone to fight for you. If Apple makes what seems to be a reasonable offer, then you would probably do better to take it than to pay an attorney - but a decent attorney will tell you if they are unlikely to be able to get more. Most offer a free consultation. Please remember that even if the ipod is defective, if no one was injured by the ipod catching on fire, you are unlikely to collect HUGE damages. Don't get carried away with dreams of millions!
I hope this is helpful and I wish you the best. I know this must have been frightening.
Apple can't do anything without the device. If the product is unsafe, they will want to know about it, but they have to be satisfied that you didn't stick a soldering iron up it or something. Your complaint doesn't read as if you did any such thing, but believe me, it happens.
As I see it, you have three choices:
1) Hire an attorney to handle everything for you, including an expert witness to examine the iPod. This will likely cost more than it's worth unless someone lost an eye or a limb.
2) Hire an appropriate product safety expert yourself - to examine the device, make detailed notes and photographs, and render an opinion before forwarding the device to Apple for their examination.
3) Take detailed photographs and notes and have them notarized before sending the device to Apple. Make sure you get particularly detailed photos of the serial numbers etc.
Meanwhile, you will have to be thinking about what you'd be prepared to accept. Replacement of the iPod, replacement of the carpet - is there anything else? Was your wife hurt? If so, how? What do you think would be adequate compensation for the whole mess? $1,000? $2,000? $10,000?
Be reasonable. If you are reasonable, and if the accident happened just as you said, you have a good chance of getting this settled quickly.

PeopleClaim is a new way to resolve disputes online without lawyers or mediators. By inviting suggestions from the public, disputing parties get ideas that can lead to settlement – and the person(s) who contributed them can win a reward.
Here's what to do: Read the case (left side of page). Then go to the bottom of the page and enter your suggestion in the space provided. Click the Solution button.
Your suggestion will be sent to both parties and will post on the claim. If the two sides agree to settle based on your suggestion, you're eligible to win. Note: Cash rewards may be split among more than one person if settlement depends on ideas from more than one contributor. If you have a claim of your own to resolve, click here.
You can submit up to three solutions / rebuttal, you would like to settle or to be voted on.
