Statement of Claim
Claimant says:
"I had an appointment yesterday (4-3-2016) at Alpine Auto Doctors, LLC to bring my car in for a few days to repair a job that apparently was not done correctly in December 2015. According to the mechanic, rodents had chewed through the wiring for the dashboard warning lights which caused them to stay on. I was charged $510.00 for these "repairs". The warning lights were still on when the car was returned to me, but the mechanic said that they should shut off after the car has been started about ten times. Well, that never happened. In fact, ALL the warning lights came on two weeks after the car was worked on.

I work and live out of the city limits so it it took me some time to secure transportation to return the car to these guys to finally (hopefully) fix the problem. I had called twice to tell them that the problem hadn't been resolved, in fact it was worse. I also made it clear that I certainly didn't expect to be charged again for work that was not done properly the first time.

As soon as I arrived yesterday, a man that I found out is the owner, Scott (didn't tell me his last name), followed me into the office and promptly started to harangue me (in front of an appalled secretary) that I did not authorize certain diagnostic tests to be done the first time I took the car in in December, therefore he is not responsible for the shoddy work done on my car. This is completely untrue. I wanted my car fixed and was not given choices regarding diagnostic tests. He was extremely rude and was just short of yelling at me. I was taken aback and caught completely off guard by his brazen behavior. Clearly, the man was not going fix my car. I calmly asked him his name and if he was the owner.
Affirmative. And then I picked up my things and left. And I am out $510.00. I am a business woman myself, and how this man stays in business thoroughly mystifies me. I'm strongly considering legal action."

    Response to Claim

    Cherie Robson brought a 2003 Acura MDX with 167,837 miles to Alpine Auto Doctors on Dec 1 2015 with her warning lights on. She wanted us to diagnose this issue, for which we did. Our lead Mechanic, ASE Certified Master Tech: Number 30123956755, had these findings and codes:
    P1454 Evap sensor Performance: sensor could be bad, or because of a leaking system
    PO 455 Evap system large leak
    PO 325 Knock Sensor no signal: signs of Rodents chewing on wires
    7201 power train system failure –rear axle clutch failure
    2601 Wheel speed sensor- no pulse – affecting ABS and traction control


    She was given this report and told what the cost to repair her vehicle in order to clear all codes. She called back and booked an appointment on 12-08-2015. She chose not to fix all the problems only the one problem directly affected the running of her engine. That was the knock sensor/ mouse chewed wires under the intake manifold. In order to replace the knock sensor, the intake manifold, had to be removed. This procedure parts and labor was quoted at 510 dollars. Cherie Robson made an appointment to repair only this problem. However, we did explain to her that she still had the other codes that will cause her warning lights to come back on. We cleared all codes at that time and told her to call us when her lights came back on.
    She called several week later saying that the warning lights had returned. We explained she needed to come in so that we could put a scanner on to check and see which of those codes returned after we had cleared them. She explained that she was too busy to bring the vehicle in. After 6 months she called to say she wanted her car fixed, that she paid us 510 dollars to fix the car and that she was bringing it in and was not going to pay any more money. Our service writer explained to her we did the job that she authorized us to fix. We had explained to her previously that her other codes would return. These were safety codes ie. ABS and traction control. The other codes were emission codes, having to do with the pollution devices on her car.
    Having chosen not to repair these other items due to time/finances over the next 6 months of winter, put her and other people on the road at risk while she continued to drive her vehicle.
    COLORADO LAW ONLY ALLOWS REPAIR SHOPS TO PROCEED ON WHAT IS AUTHORIZED BY THE CUSTOMER.

    She finally made an appointment to come in for us to check the warning lights. Telling the service writer she would not pay for any work since she already had paid such a large amount on previous work done. She arrived 45 minutes early (during our lunch) and was filling out paperwork. The owner of the company Scott came into the reception area and asked Cheri what her goal was for that day concerning her vehicle repair. Cheri said that she was not going to pay for more work on her car, that we did not fix the car. Scott’s response to her was that "we had repaired only what she authorized, and how would she like to proceed with the remaining repairs. Cheri’s response was that she had already paid a large sum to fix her car and was not going to or willing to pay for work that was not done correctly. Scott’s responds was again “we repaired what you authorized” that one code was fixed unless you have had more mice in the last 6 months.
    Scott became upset with her not taking responsibility for the other work she did not want to repair, that had been previously diagnosed. We are not willing to work on her car for free. She has to be willing to have the work done that is causing the rest of the issues which is the reason her warning lights keep coming on, ie, Traction controls, Emission leaks, and ABS braking problems. She needs to refer back to the original invoice and diagnosis. She has a the car with 167.000 miles and mice problems. No refund will be given for work that was done properly within the scope of what she authorized.

    Cheri has gone on public websites and slandered the business and me personally, which has opened up a case for personal slander, therefore we expect her to cease and desist and remove these comments from public websites.
