Statement of Claim
Claimant says:
"I purchased a 12 year old Peruvian Paso horse from Shannon Pagliuso,sight unseen on Oct. 27, 2013. I was told the horse was in good health and anyone could ride. I paid $1500.00 plus $650.00 to get him here. When the horse arrived I could see that something was wrong with his legs.
I called my Vet.and found out that the horse has (Equine Suspensory Apparatus Dysfunction in the form of Degenerative Suspensory Ligament Desmitis. DSLD. This is not curable and the horse must be euthanized before long. I have had two Veterinary's confirm these findings. At the cost of $309.00 I feel Shannon owes me $2459.00"

  • This horse was purchased as is. carol was advised to do a pre purchase exam. And come ride and see the horse before buying it. She elected not to do either of my recommendations. She bought the horse sight unseen against my advise. The horse was sound at my ranch and we had even rode him 2days before he was picked up by the hauler. Carols claims are unfounded and that is not how I run my business.

  • Horses can not get DSLD in 2 days. Reports state "It is believed that heredity can play a role in developing ESLD in some horses through both the conformation of the skeletal and the internal suspensory apparatus of the horse."

    So in essence the buyer did lie about the horse, plain and simple. She knew she had a bad horse and sold it to the first fool that took it sight unseen.

    This is a classic case of buyer be ware. WHY oh WHY would you buy a horse from someone you don't know with out a vet check?? I'm sorry but that was really dumb on your part.

    So both of you are wrong in this case. I would return the horse and get your money back and you will have to eat the transportation fees. That is what a case in court would tell you. If it was my I would euthanize the horse to put it out of it's misery and be more careful when you buy the next.
