Statement of Claim
Claimant says:
"I was scheduled to fly on JetAirways flight 432 from Mangalore to Dubai, connecting through Mumbai. The flight was to leave Mangalore at 3.50 PM, arriving in Dubai at 8.45 PM (10.15 PM Mangalore time).

I had looked at all available flights, including a much cheaper flight leaving at 11.25 PM and arriving at 1.45 AM Dubai time (3.15 AM Mangalore time). However, because I had to be up very early for a breakfast meeting I elected to pay a substantially higher price for the earlier flight. This was so that I could comfortably get to a hotel and be well rested for my meeting, rather than trying to grab a couple of hours on an airport bench.

I therefore paid $327.60 for the earlier flight and booked a non-refundable hotel room in Dubai at a cost of $180 - instead of paying $124.60 for a red-eye and catching a quick nap at DXB. I arrived at IXE in plenty of time to catch my flight.

For reasons that were never explained, Jet Airways flight 432 was delayed to the point that I would miss the connection. As a result, not only did I waste an additional 7 hours hanging out at IXE, but Jet Airways also put me on the red-eye that I had specifically paid more to avoid. It was a train-wreck.

Because Jet Airways put me on the very cheap red-eye instead of the expensive flight that I paid for, it is more than reasonable to ask Jet Airways to reimburse me for the difference. I would NOT have booked a $180 hotel room for an hour's nap and a quick shower, and I would NOT have paid $203 extra for the early flight if I'd known that Jet Airways was going to blow it when there wasn't even any bad weather to justify a delay."

    Jet airways being a legally and morally obliged body has to make up for the loss caused by refund of amount to the extent of $383 and an additional compensatory damages of $100 for the loss and discomfort caused to the claimant.
