  • Dear Mr. Emachah, thank you for your response. However, your offer is rejected. I would advise you to pay the entire amount due as I have every intention of suing you in small claims court (starting December 1) at each of the townships for which we provided service. I spent the week before Thanksgiving investigating the processes at each of these towns, compiled a file on each address, and am prepared to invest my time to go on the record. Immediately thereafter, I will send a letter to each of the homeowners with a copy of the small claims lawsuit, informing them that you have failed to pay us a subcontractors, and that we intend to pursue filing liens on their properties. I will include copies of the email correspondences between both of our firms. I am offering you an opportunity to avoid the public shame, countless counterproductive hours you will have to invest into avoiding paying what you owe, and allow us to move on with our lives. Please be guided accordingly. Regards,

  • Before resorting to small claims court, perhaps the parties can agree to some form of dispute resolution offered through the state. New Jersey, through its Department of Consumer Protection, has an option for either mediation or arbitration for disputes involving businesses that the department specifically regulates, such as contractors. That way, the parties can sit down and discuss the dispute here, and possibly come to an agreement on the issues. If not, possibly some form of payment plan can be worked out. I see the respondent has offered a counteroffer, what about if that could be counted a down payment towards the debt that the claimant has quoted?
