First of all this incident happend 5 years ago and i had no idea the watch was fake i traded her the watch with the knowledge it was real and she had it checked almost a year later sorry but i am not responsible for her ignorance she should have had it checked before the trade.
His respond was irrelevant! Look at my complaint. 1. Failure to disclose facts.He made up a story about where the watch come from. He said its 100% real but told me not to take it to carter store. he was rushing me to swap it without allow me to think. it made total sense why because he knew it was fake and he was failure to disclose the facts.2. Failure to honor promises:I told him very specific, if he ever going to sell my watch, I asked him to let me know I would buy it back. However, he failure to honor any promises, he went ahead and pawn my watch for $400.The objective here is He pawned my watch without notify me and then he didn't even bother to pay the interest fee or called the pawn shop at all. thats why the pawn shop sold the watch. the owner from the pawn shop is 100% support my claims and will submit his statement or testify if necessary. Lastly I am not going to make any comment on David Puga's jr called me ignorance or any other names nor I would use any adjectives word to describe Mr. Puga Jr. characteristics and behaviors. Because I am here simply to seek justice. Thank you!
I don't understand exchanging watches - is it a romantic gesture, like giving each other rings? Since this is between a male and a female, I'm going to assume so.
If you give a gift, you've given it. But if you trade watches with a caveat about pawn shops, that's not a gift. David Puga Jr. should have taken the caveat seriously.
David Puga says the claimant should have checked the value of his watch right away. When I was in school I worked extra hours and saved up to give a girl a gold locket. She called me the next day to tell me she'd taken it to a jeweler and they told her it wasn't worth much. I immediately dumped her. Who does such a thing?
If David Puga was going to pawn a watch that he'd exchanged, it isn't good enough to say "I didn't know the one I gave her was fake."
An honorable man would have called her to say, "I need money and I have to pawn something; let's trade back and I'll pawn MY watch." The fact that he didn't says a lot - including that he knew he wouldn't get anything for HIS watch. That's bordering on theft by deception, in my opinion.
Not making the interest payments and/or alerting her to the fact that he'd pawned her valuable watch is even worse. It showed total contempt for the claimant, her property, and her feelings.
Yes, in my opinion, he owes her a Cartier watch. If he can redeem her own watch, so much the better. What a depressing waste of space he must be.
