Statement of Claim
Claimant says:
"Mr. Casa Oliver is the owner operation of a use car lots and towing service. He also purchase cars at auto auction. Mr. Oliver take these cars and sell them. That is ok, but he mislead his customer's to believe they are sound vehicles and need very little work if any. I purchased a 2003 Chevy Malibu, 4 door from Mr. Oliver. He had cleaned up the engine very well. You could not spot a leak or drop of oil. He had the radiator full of fluid as well as the windshield washer. We cranked up the car and there was a little white smoke, but he said it was because it was cold; but the engine and exhaust is find. We test drove the car a mile are so and did not notice anything, so we agreed to purchase. He listed it for $2400 but reduce the price to $2000 after we sited a few obvious exterior siting. My dad drove the vehicle home and parked it in the yard a couple of days until I got insurance and registration. Meanwhile he repaired some internal things such as the arm rest and glove box. 3 days later I dove the car for about 5 miles and it began to run hot. I added coolant and it sill ran hot. this was day 4. I took it to pep boys and found out it needed radiator as well as manifold. The technician stated the radiator was full of stop leak. 'the total repairs came to $1700. I drove it for 2 more days and the next day after driving 4 miles to a friend's home , the car would not start. we tried jumping it and no use. We had it towed to pep boys. They found that a spark plug was causing the problem and then they also find that the engine was loosing pressure. the engine was cracked, it also appeared that Mr. Oliver had place some fluid in the engine that would help sill cracks. the mechanic stated this fluid is could hide the crack for probably two or three months, dependent on how you drive. they conducted a test and found a new head will be require or the car will continue to loose pressure when you drive. We paid $66.00 for the towing and another $120 for the diagnostics. I have not had to car two weeks and have spent over $2300. I called Mr. Oliver and advise him of the problem. I asked if I could bring it back and trade for another vehicle. I did not asked for my money back, although I believe I deserve it back plus my out of pocket expense. He refused and hung the phone up on me. It will cost me another $700 dollars to drive it and the mechanics can not assure me that I will not found something else wrong. the reason the say this, is they can tell that who ever sold this to me, went out of their way to hide the problems with the Engine and coolant system. I know you buy a used car "as is" but there should be a law against trying to hide behind that law and deceiving honest customer. I was advised that even a good mechanic would not have caught those deceptions. I want Mr. Oliver to either take the car back and give me my money or give me another vehicle the same value; however one that I can really use and not spend extra money to get it to move. I have a job and going to school. this car was going to be a much needed help and blessing; but instead it has been a nightmare. Please help me."
