Statement of Claim
Claimant says:
"After spending nearly $400, VSI has not come through for me.

Original order of $200 for 200 certificates and shipping arrived in the fall of 2010. I then paid another $99 for the Platinum distributor card which should have included 50 more certificates. The card came very delayed, though the extra certificates never arrived.
In the mean time, I spent $101.10 for a redeemed certificate to test the system out so that I could better serve my cleints ($100 for the certificate and $1.10) for the money order, thus bringing my total to $400.10 spent with VSI.

Ironically the back of the Platinum authorized distributor card says "The above named person has agreed to conduct fair and ethical business transactions and strictly follow the Distributorship Guidelines set forth by the parent company"

It was January 2011, when I sent in a $100 money order with the certificate, expecting to receive my Three $100 gas cards and bonus $25 store card. I did not receive any, but instead got the ‘new’ rebate cards, which I never activated because I never received a reply in regards to concerns and questions I had about how they worked.

The only thing I got was two letters and a check for $46.86 from the lawyers representing VSI. They claimed to not be able to receive any more email contact and I wrote a letter with concerns as seen below.

“I have a few questions/comments in regards to the Terms and Conditions associated on the rebate forms
A) #4 the last sentence refers to the 1st voucher mailed…Is this like cash or is this another rebate form that then gets mailed back to the person weeks later? Also, with the ones I received, would I just send them back in with a receipt and get a rebate check in 8-10 weeks as I did not have a set store chosen from the new original voucher that is mentioned.
B) #6 mentioned spending $100 in gas, but only being able to redeem $25 a month in rebates. This is totally the opposite direction of the original offer, where you are spending 100 and getting 25 back versus spending 100 and getting 325 back in cards. The extra store card mentioned only using 1 per year, but the gas card was one per month, which would total 12*25= 300 for the whole year. Is this the extent of the whole promotion as stated above, this is compared to being able to do this every month as in the original offer.”

“I also am curious in regards to the way a distributor would make money with this new method. Are we linked to certain cards and would get a commission on any ones turned in per month. There is a line that stated “company you received this offer from” and I would like this to be clarified in regards to how we would therefore make money here.”

As you can see, I was willing to work with them if they would just answer my questions and get back to me in regards to switching my certificates.

I never heard back, so I wrote a follow up letter in October 2011 stressing the same issue and letting them know I still have not cashed the check which as they stated in their letter in bold and underlined "Acceptance of this check is a full and final waiver of any rights you may have against Venture Services International, its distributors and affiliates."

If they had responded and worked with me I would have continued to provide my clients with the service, however they again neglected to write back as that is how all their correspondance was supposed to occur.

Now well over a year into this whole scenario, I feel I would like my money refunded complete and in the full amount totaled above."
