Statement of Claim
Claimant says:
"I feel this dentist gave me false information prior to visiting him, the promise was "same day service" and it turned out to be five days. I was told this was because I was 15 minutes late for my appointment. it was to make me a bottom partial and without it I can't chew. I am supposed to get my new partial on Tuesday. I hope since they have a lab on premises."

  • I WAS NOT 1 HOUR LATE...ONLY 15 MINUTES AT THAT TIME I WAS NOT TOLD ABOUT TAKING IMPRESSIONS THAT DAY. AS A MATTER OF FACT, DR. MASONE AND HIS FEMALE ACCOMPLICE DID TAKE IMPRESSIONS EVEN PUTTING SOME KIND OF CLAY OR PUTTY TYPE MATERIAL ON MY UPPERS. I DID RETURN THE FOLLOWING WEEK (MORE GASOLINE AND TOLLS) AND THE WOMAN ASSISTANT WAS IN THEIR LAB WORKING ON MY CHEAPER PARTIAL. AN HOUR LATER SHE TRIED TO FIT THIS PARTIAL AND, AFTER SEVERAL UNSECCESSFUL TRIES I SAID LET ME HAVE THEM THE WAY THEY WERE. I CAN UNDERSTAND THEM TOUTING THEIR PROFESSIONALISM BUT THAT DOESN'T SIT WELL WITH ME. I STILL HAVE A PARTIAL I CANT USE AND FOR OVER $400. I FEEL FAIRNESS SHOULD PREVAIL WITH ABOUT $400 RETURNED TO ME. IF THEY ARE FAIR.

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "It is the position of this dental practice that we have done everything possible to accommodate Mr. Lepage. We do in fact offer same day service on partials and dentures in most cases, however, this is dependent on the patient’s ability to arrive on time and begin the process. Mr. Lapage was one hour late to his appointment, not 15 minutes late. Our hours of operation are 8:30 to 5:30 Monday –Thursday. His appointment was on Thursday. We offered to either reschedule him on a day that would accommodate a same day pick up of his partial denture (which would have been Tuesday), or we could take impressions that day and let him pick up his appliance on the following Tuesday instead of having to come back twice on that day. We feel Mr. Lapage was fully aware of the reason we were unable to make his appliance that day. We understand sometimes unpunctuality is unavoidable, and we still made every effort to treat Mr. Lapage with proficiency and professionalism. We make no acknowledgement of any wrongdoing and for this we reject his proposal. We feel no settlement is idicateded."
