Comment: On 2/1/2012, While walking into the McDonalds my wife stepped on the sidewalk, slipped on the ice and fell onto her face. She sprained her wrist, had contusions to her face, broke her eyeglasses and smashed her telephone. We notified the store manager, Debbie, and she came out to the sidewalk and confirmed that it was icy and asked one of her employees to spread icemelt. Debbie stated that if we needed medical attention to go to the hospital and McDonalds would take care of it. Debbie also saw the broken eyeglasses and gave Louise a bag of ice for her wrist. The water off of the roof does not cover the sidewalk and allows ice to build up for the first twelve inches of the sidewalk. We made out an incident report and went to the hospital for xrays of her wrist. My wife contacted Douglas Cheever, Restaurant Manager, on 2/2/2012 and he provided her with the name of the insurance company and the claim number. We did not hear from the Insurance company as of 2/3/2012, Friday @ 1:17pm so she contacted Douglas Cheever again. We then heard from an adjuster @ 3:30pm, Vince Ryan, of York Risk Services who then taped my wife's description of the accident. He said he would get back to us by the middle of next week (2/8/2012) as he hadn't contacted the store yet. Claim AKMG2614A1. He stated they were not a medical insurance company and he had to assess who was at fault. We were told that McDonald's would take care of our expenses by the night manager, Debbie, but are concerned that the response is taking so long from the insurance company. We had to pursue the insurance company to take our statement.
On 2/14/2012, Vince Ryan called and said he was aware of the roof overhang and the snow on the roof but that didn't cause the accident and that the store wasn't liable for any damages. We disagree with his statement because the water dripping off the overhang and landing on the sidewalk formed ice. This was confirmed by the night manager, Debbie, as she witnessed the ice at the time of the accident.*” ...Show less »
