Claimant says: "On 02/11/11, I purchased item 37E200U Toshiba 37 1080p High Definintion LCD flat Panel televison for $649.99 plus tax $54.44 (8.375% New Rochelle) total sale $704.43 under order no. # 62694 from above vender. Sale person Wendy Zohn. At such time of purchase at store I gave Zohn size of space for television to accommandate (H 25W 45). Televison was delived (3) days later by their serviceman for installation. When serviceman unpacked set and tried to place in space it was approx. 1/4 to high and did not fit. He call Zohn at store and told her situation and said he would go back to store and get a 32 televison that would fit and a credit would be issued to me on set size change. I waited approx. (2) wks. for the credit to be issued, a new invoice for proof of purchase for new television, and a void of my original visa invoice charge for the 37 Toshiba set. Nothing happened. I called Zohn at store and asked about credit for smaller t.v. set and she stated that the smaller t.v. was same price as 37 t.v. I said that national adds showed that the set was at least $200.00 less in value and I should get the credit. She then said I returned a used set, which her serviceman couldn't install because of height over 25 which I told her the size of space required at original purchase which had to be accommanded, and her serviceman repacked the 37 in original box and took it back to store for exchange to smaller 32 set and came back to my home to install. On 03/01/11, I wrote her at the store and told Zohn that I needed a bill of sale for the new 32set for proof of purchase and warrenty at $704.43 for proof of purchase, and also I wanted the original invoice charge of $704.43 credited back to my visa account for the 37 t.v.
To this date, 03/25/11 nothing has been undertaken by the store. My 32 Samsung Series 5 Model # 550 LCD TV I have no invoice for proof of purchase, no credit has been advanced for the purchase of a smaller t.v. set, and no voiding of my original visa charge for the 37 t.v. of $704.43.
I would like to receive an invoice for proof of purchase and a dollar credit amount for attaining a 32 tv instead of a 37 tv. All national retail chains are showing the cost range for a 32 tv from $350.00 to $450.00. Sony at the highest price of $449.99 at
