Claimant says: "Hello.
My name is mr. Garegin Stepanyan.
On July 2nd I sign Move Out Notice in apartments I am currently leaving( The Point At Steeplechase) because in Apartment Finder Magazine for July I saw apartments with more affordable price.
On July 3d I spoke with mr. Andrew, Relocation Specialist of Hunter's Chase Apartments Homes and he told me apartments they advertize in magazine for price 391$ is not available and he said he is not able to tell me when they would be, and I took his advise and stop a few more times to check it out but only more expansive apartments was available. He offer me take a look at apartment they have for show but I respectfully decline it for two reasons 1st I am not signing lease for apartment I never saw ( besides I heard from people already living in this apartments mr. Andrew practice to show apartment in good condition and when people moving in, actual apartment people moving in need major repair such as plumbing and roof leaking), 2nd I was looking to reduce my bills and I was willing to leave in apartments with no gymnasium and was no interesting in more expensive price but I saw in magazine.
On August 6th I looked at Apartment Finder Magazine for August and I found same apartments for same price - 391$ . I stop at Hunter's Chase and this time I have spoke with mr. Alex, who explain me if I want apartment for 391$ I have to live on 2nd floor. I accept it and was ready to sign a lease, but mr. Alex was able to show me apartment only on 1st floor with just one minor problem: thermostat on condition wasn't working he was willing to fix it but I wasn't interesting in apartment on 1st floor and I told him I will sign s lease if only I will see it with my own eyes and I don't care if this apartment have exactly same floor plan as on second floor. At this visit to Hunter's Chase my attention caught pool, I was told by mr. Andrew they fixing pool and it is matter of a few days, well it was already a few weeks. Mr. Alex share my concern and offer me to make a deposit 100$ to make a sure that apartment on 2nd floor will not be taking by others people and I ask him what is going to happen if I will not like apartment or it will not be ready. He told me I will lose 25$ and 75$ is refundable, I called to my wife discus it , we found it reasonable and same day I made a deposit 100$ for apartment #184 by money order. Mr. Alex told me apartment would be ready to look by August 14.
At August 14 it wasn't. Mr. Alex wasn't available but I spoke with ms. Erica who I was told from now working with new leases and she told me she wasn't aware I was coming. I said it is ok misunderstanding sometime happening, my question was When? She told me by August 21.I told he it is acceptable but I also told her I don't want wait to much longer and I will sign a lease before September with them or other Apartments.
At August 21st apartment #184 wasn't ready: no stove, carpet was nasty and filthy, roaches all over kitchen including Pest Control Sign. Pool was locked, still. Most amazing ms. Erica told me my application wasn't processed and she request from me paystubs from my job. I came home and I wrote e-mail with all problem I found in apartment #184 and attach to this e-mail 4scans of my recent paystubs. I never got respond to this e-mail. But on August 24 I got a phone message from mr. Alex he informed me the apartment ready and he ask me to bring paystubs.
At August 28 I stop by Hunter's Chase Office with paystubs copies and found ms. Erica available and she told me in order to sign a lease I have to buy insurance. I ask her why and she told me that is Texas law and I told her it is pretty much wrong for two reasons 1st if it is mandatory I should be aware of this from very first conversation and 2nd I am not a lawyer but I am living in apartments in Texas and nobody forced me to buy insurance -it is my optional if I would like to protect my thing but walls and building protected by owner's insurance I know that because it same as in Florida where I have to rent my home and I have to buy insurance for that home only and same again if my tenant want protect his TV he have to buy his own insurance. She was trying to convict me that is Texas law but mr. Andrew overheard our conversation and he put it this way it is not a Texas law but in order to live in Hunter's Chase Apartment Homes I have to buy insurance because I could be a reason if apartments will burned and that is for my own safety. At that moment I call to apartments I am currently leaving and ask how much they would like me to stay over for another 12 months and they offer me a discount. So I told to ms. Erica I want my money back and she told me she need to speak with manager. I said ok and left. Same day I cancel my Move Out Notice. And going a little ahead; renew a lease a little later.
On September 4 I stop by Hunter's Chase Office to collect my money and found only mr. Andrew available I told him why I came and he told me he is not able to give me my money for reason money went to bank he didn't offer check he didn't offer any solution and I told him this is wrong and he told me to live his office I told him I will call a police he wasn't scared and a few moments later I learn why: I was told it is not police matter. At this time I saw other people came to Hunter's Chase Office to look for apartment and I wanted to warn them about trouble they could get. Mr. Andrew began a dialing 911 and said police will arrest me for Interfere With Business. I left.
I claim 75$ +7.95$ claim fee
I claim writing apologies from Hunter's Chase Apartment Homes.
