Statement of Claim
Claimant says:
"I have a small business and my banker offered me a credit card services for my customers. The manager and the one of the workers of the branch came to my house to talk to my husband and me about the service, so both of them told us about the monthly fees for this service going to be 44.00 only, no hidings fees and a contract for 2 years but I found out that contract that she mention to me was only for the account, and she never ever told me about the other contract with the machine company for 5 years .... so 1st month the bank charged me 45.00 plus 46.00, the 2nd month 46.00 plus 55.00 that does not include the interest of the transactions...... so STARTED GETTING BILLS FOR around 150.00 for fees only...
I ASK TOLD WAS ONLY WILLING TO PAY WHAT WE AGREE ON ONLY OR I WANTED TO cancel my services and they promise me to fix this mess but they did not do anything. SO I STOP PAYING I MADE VERY CLEAR IN THE BEGINNING I WAS ONLY WILLING TO PAY THE 44.00 AS THY STATED AND NO MORE AND THEY PROMISED ME IT WOULD NOT BE HIGHER THEN 44.00 PER MONTH.. THEY ETHER LIE OR DID NOT KNOW WHAT THEY WERE TALKING OBOUT

by the way the location of the branch is in palm desert california (monterey ave)

  • dont talk to an attorney- thats a crazy suggestion because it will cost you far more than you are out of pocket.

    You are entitled to full disclosure of any fees and as Jennifer suggests any fee arrangement should have been in writing-otherwise you most likely wouldn't be obligated to it. is it possible that you signed something that agreed to both fees but you were mislead verbally that there would only be the lower fee? If thats the case you still have a claim because you would have received a verbal representation that was different to what the contract said. In court you might not win- another reason for not using a lawyer- but Wells Fargo has a moral obligation to fully disclose all fees in a way thats clear and understandable, regardless of fine print in a contract.

    Did you call or talk to a manager? hopefully they will see this claim and do the right thing.

  • Do you have all the copies of the contracts or agreements you signed with Wells Fargo for the service and the machinery? Did you only sign the one contract with the account/service itself? If you have copies, and you in fact signed a contract for the 5 year service for the machine, you may want to speak to an attorney to know if you have any rights or remedies available to you. Even though someone was explaining the contract, it’s possibly you did not understand what you were signing, otherwise you would have know about the 5 year machine contract with extra fees. A legal consultation can definitely help you in this situation.
