"Subject: Complaint Against Joseph Littky and Real Estate Agent/Broker Homaira Mangal of Echo Fine Properties in Palm Beach County, Florida
We allege the following and are writing to formally lodge a complaint against Joseph Littky and Homaira Mangal (also known as "Homie" confusingly using multiple names), at Echo Fine Properties in Palm Beach Gardens, Florida. We believe serious violations of Florida real estate law, as well as potential violations of federal law, resulting in fraud against our trust (the seller) during a real estate transaction. Despite multiple attempts to resolve these issues directly, Homaira has been entirely unresponsive. Below are the alleged complaints and the potentially associated violations of Florida real estate and federal laws.
Issue 1: Unauthorized Diversion and Release of Escrow Funds
Homaira Mangal was hired to sell our property. At the closing table, she demanded a change in terms, requiring us to leave a $5,500 security deposit in escrow until the end of a previously agreed-upon rent-back period. After this period ended, we attempted to recover the $5,500, only to discover that the funds had been diverted to Joseph Littky, who non-responsive. We seek immediate recovery of this money.
This deception appears to violate:


Florida Statute §475.25(1)(d): Prohibits real estate licensees from making material misrepresentations or false promises.


Florida Administrative Code 61J2-14.008: Outlines the proper handling of escrow funds.


Federal Real Estate Settlement Procedures Act (RESPA): Prohibits kickbacks and unearned fees, and mandates transparency in the handling of escrow funds.

Issue 2: Misrepresentation and Coercion Regarding Property Value
Homaira provided misleading information about the property's value in an apparent attempt to secure a quick commission. Initially, a misleading valuation was provided, but the parties eventually formed a contract anyway. During the transaction, Homaira Mangal and Joseph Littky claimed, without any documentation, that the appraisal was low and pressured us to lower the sale price by tens of thousands of dollars. The buyer also harassed us, echoing Homaira's insistence on the price reduction without providing any supporting documentation.
After numerous requests, we finally received a suspicious appraisal with nonsensical adjustments. The appraiser and lender refused to respond to any communications. Despite this, Homaira, likely fearing that the scheme would be discovered, suddenly stated that Joseph Littky would proceed with the original deal and instructed us not to attempt any communication with the appraiser or lender again.  
Shockingly, at the closing, the documents revealed that Mr.Littky received the appraised loan-to-value ratio as if there had never been any issue with the appraisal. When questioned, Homaira refused to provide any explanation.
This situation suggests a conspiracy involving Homaira, the lender, the appraiser, and the buyer to defraud us, potentially violating:


Florida Statute §475.25(1)(b): Prohibits making false promises and misrepresentations.


Florida Statute §475.25(1)(e): Prohibits conduct which constitutes fraud, dishonest dealing, or negligence.


Federal Real Estate Settlement Procedures Act (RESPA): Requires transparency in real estate transactions and prohibits kickbacks and unearned fees.


Racketeer Influenced and Corrupt Organizations Act (RICO): Addresses conspiracy and fraudulent schemes in business practices.


Conclusion
In light of this, please provide assistance in recovering our damages and addressing these alleged breaches of Florida real estate and federal law. All relevant documentation is available upon request."
