Statement of Claim
Claimant says:
"On 12/10/2014 we purchased a loaf of the Arnold Nutty Grain bread for some sandwiches. In one of the slices of bread we discovered a staple baked into the loaf of bread. On contact with the customer service line we were given a replacement loaf and asked to send the foreign matter to their lab. This is unacceptable the person consuming the bread could have broken a tooth or worse yet, swallowed the staple then who knows. On top of that, who knows what other contamination could have occurred in the plant if something like a metal staple can make it into the bread dough.

I did receive a package to send the debris back to a lab but, do not feel my best interests are in play. The Customer Service Team seemed very eager to get the foreign matter out of my hands before I could have a chance to decide what action to take.

We have pictures taken at the time of discovery.

Received call from Customer Relations Director who advised the matter entered somewhere in the distribution chain as determined by an independent lab. The lab states the bag showed signs of puncture where the matter made entry. This is somewhat inconsistent with the location at which the matter was found (embedded below the crust line in the bread) because, for that type of penetration to occur it would seem that the bread would have shown some signs of crushing. The company states they are sending a $20 gift card as compensation. This is in my opinion not acceptable as we could have incurred serious injury."

  • 12-10-2014 — Bought bread at Publix in Jonesville Florida
  • 12-10-2014 — Contacted Bimbo and received voicemail messaging service. Did not receive call back on next day in response to my message
  • 12-11-2014 — Contacted Customer Service number again and advised no contact had been made per message left night before. CS took information and advised they would send coupon to replace bread and kit to send foreign matter back to their lab.
  • 12-15-2014 — Received kit from vendor. Shipped requested items back to vendor.
  • 12-10-2014 — Took pictures of foreign matter and packaging.
  • 01-05-2015 — I just spoke with a representative from the Bakery who states that an independent lab reviewed the foreign matter and determined that it did not enter the product during the preparation process; rather it entered in transit. I find this hard to believe considering the foreign material penetrated the crust and was inside the product. In order for that to occur I would think the bread loaf would have been dented or crushed. Bimbo states they are sending me a $20 gift card. I do not find this satisfactory at all and wish to pursue this further
