Statement of Claim
Claimant says:
"I entered dealership as a customer looking to buy two cars and found them. Under the salesman's assurances (Dwayne Pogue) that if I am not satisfied I could bring cars back and return with no questions asked and I had a witness to this verbal statement by my witness Trina Crivella (Friend). Within 48 hrs. I returned to dealership to return Dodge Charger 392, where I was met with a very not so understanding managers (Ron Sedakis and Derek Roller) who refused to take car back for which I stated I was not content with car and wanted to return like salesman stated I could do so. So I have had this car and have not driven it since and mileage is still low and is not over 100 miles since date of purchase. I am very unsatisfied with the service and professionalism of the manager on site who handled my interactions and I wish to file a complaint and still am looking to return car to this very date. I will not drive and will not pay a dollar towards this car because saleman's (Dwayne Pogue) conditions were met by myself in regards to returning and not satisfied until car is returned with a complete drop of contract!"

  • Oct 09, 2018, Claiming party added:
  • The problems and conduct of the employees and management at this location is still a problem along with harassing comments to extort more money from Mr. Dumas after the deal was closed and conducted. Mr. Dumas has and always have had access to bringing the car back to dealership as the only reasonable resolve at this point and cancelling out whole deal all together! So Yates can stop avoiding the apparent issues that have already been stated in my complaint and my complaint is relevant regardless of location of my vehicle! So now what is their response? More avoidance of the problems and issues or complete return and cancellation of deal? That is still on the table!!! Everything I do will be made public. Not answering my complaint is a sure way to affirm that their conducts are exactly as I stated and they do not want to address that in any way shape or form!

  • Oct 09, 2018, Claiming party added:
  • The Yates dealership informed me today in person that additional funds were needed for ADOT reasons that was their mistake and falsely inputting information without proper documents to support their actions; or my deal was not valid and if that the case then they should be willing to take the car back since I still have the car they say I don't have or even have access to! I can bring the car back at anytime they want it and if they don't want it then accept the complaint as me being a customer, it is my legal right to file a complaint against any entity who has put me in the place of wrong doing being done to myself! So my claim is valid and current! If they will take it and cancel deal in writing I can have the car back to them as early as they need it! But as I have already endured their stall tactics already these actions are now under a timed response for any course of action! Just to be clear a reasonable amount of time should be what they did not give me under their honor and that is 3 days from today!
