Statement of Claim
Claimant says:
"I leased a new 2017 Elantra from Windward Hyundai and was planning on purchasing the vehicle at the end of my lease until the vehicle started having mechanical issues. I was almost killed in this vehicle that stalled out on me over 40 times just trying to get home from work one day. I ended up having this vehicle towed back to the dealership, back in June 2018. Three weeks later later, I called them, because meanwhile, I am renting a vehicle, borrowing, and asking others for rides to and from work . They said they didn't know what was wrong with it. Another month goes by and they finally call me saying they changed the oil and the car works fine now!! Sorry but I have a hard time believing that, so I told them I want another vehicle or something because I do not feel safe in this car, just to finish out the leas which is July 2019. They had me go down and they said I can do that but wanted me to sign and entire new 3 year lease.. I told them no way do I want another one of their vehicles at this point. Their vehicle was horrible, customer service is horrible and why would I want to do that? Meanwhile I am still paying the payments on this car and the insurance. I tried calling the Corporate office and got the run around with them too. I told them again, I do not want that vehicle but was willing to get another vehicle to finish my lease term. I left several messages went to Hyundai and no one would help me. So 2 months ago I quit paying the payments and now my credit is being affected. I was finally able to talk to Jerry V himself the day before yesterday and he too tried to convince me that changing the oil was all that had to be done, that "someone" put the wrong oil in the car to make it stall out like that. I reminded him it was a Hyundai dealership that Now they have given me the option to pay the rest of the lease off, "ground the car" and I will still changed the oil!! Now he said I have to pay the difference and the lease or it affects my credit... Help! This has been going on for almost 5 months now!! I ended up purchasing another vehicle because I do work 2 jobs and am raising my grandson that I need to transport to school and such in a safe vehicle. Now it has become a financial hardship trying to pay for 2 vehicles!"

The claimant's settlement terms were rejected with the following explanation:
  • "Hyundai Motor America will only repurchase/replace a vehicle, or in this case take the customer out of her lease, if the vehicle's repair history meets the criteria of the state Lemon Law. Her case was already evaluated and it doesn't meet the criteria. Secondly, there hasn't been any additional repair history to review since the last evaluation was complete.
    Lastly, the customer made a choice to stop making payments on her lease. The manufacturer and the dealership are not responsible for that choice. The dealership and the manufacturer are responsible for repairing the vehicle. If the customer is still having concerns with the vehicle she needs to take it to the dealership and have the vehicle diagnosed and repaired. "

    Did Windward Hyundai explain WHY the car stalled out more than 40 times and how an oil change would have fixed that? Doesn't make sense to me.
