Statement of Claim
Claimant says:
"My son Joseph M DiPrima was a tenant at Whispering Pines. however, because of his Mental Illness we received complaints from Donna Ball about disturbing the peace among his two neighbors. So before he got evicted we decided to move him back with us.
on Septemer 27th 1014 my wife informed one of the office workers namely Paul that we were moving him out. As a matter of fact my wife gave Paul the payment of $850.00 to pay for the following month of Oct.

Having said this, we received a letter from Whispering Pines on the 27th of October indicating that my son would not receive his Security deposit of $850.00

Because of the circumstances surrounding my sons case we believe that he deserves to receive his Security Deposit.

We would Greatly appreciate your cooperation on this matter.

  • A security deposit, as I understand it, is to cover any damage and/or excessive wear and tear of the rental property. Since the rent was current, the tenant moved out timely, after paying one additional month, and it was clearly as a result of medical issues, and there is no mention of damage, the security deposit should be refunded with interest.
