Statement of Claim
Claimant says:
"To whom it may concern:                                                                                                             March 27, 2017
In May 2015 a young man walked up to my door and asked me if I had a security system. I told him yes, that I was with ADT; he then proceeded to tell me about Vivint and if I decided to go with them they would be able to use ADT’s equipment and only would have to install a new Vivint panel and camera. So I said okay.
When their installation people arrived it was quite hectic and I remember talking to one of the techs about how the motion sensor that ADT installed they put in upside down so as my dog wouldn’t be setting it off all the time. At no time was I told there was no motion sensor, smoke detector and that this was a five-year contract. I was led to believe by using ADT’s equipment that I would have both a smoke detector and a motion sensor when Vivint’s techs were done.
After having the service for over a year I decided I was not happy with it because of how much it was costing me. I tried calling to get my payment reduced by threatening to cancel; during this process it was extremely hard to get a hold of anybody when you selected “to cancel service” option. This upset me and when I needed to talk to them after the initial phone call I would always select “new customer option” and somebody would answer right away. It was during the initial conversation (when I called trying to get my payment reduced) that I learned I was in a five-year contract. I would never knowingly sign a contract for five years for anything (other than a house payment or car payment) or any reason. Duping me into this five-year contract they were using deceptive practices because it was never mentioned at any time.
As time went on my wife had a grease fire in the kitchen and are smoke detector went off, she was able to put the fire out but was hysterical. When I got home she wanted to know why we did not receive a call from Vivint. She said “the other company would always call when the smoke detector went off why didn’t this one”. I told her I thought we had it to until several months earlier I had called when it went off before and nobody responded at which time I was told we didn’t have its. My wife couldn’t understand why we didn’t have it because we had it before and Vivint was supposed to replace ADT service. Again, I told her I thought we had it to. Recently, I decided to check to see if we had a motion detector and set the alarm for “leaving”. After the alarm was set for a while I walk through the hall way waving my arms above my head expecting the motion detector to go off which it didn’t. As far as I was concerned Vivint has not lived up to their part of the agreement. I called Vivint and disconnected the camera service. This took $10 off my bill and I could never connect to it with my tablet; there was always something wrong with the camera and it wouldn’t work.
I am asking that I be reimbursed $1649.27 for deceptive practices and failure to live up to your contractual agreement. The amount mention covers from May 2015 until and including March 2017. There will be a $49.99 charge added to the said claim for each additional month it takes to settle this case.
If this dispute cannot be settled within 60 days from the date of this letter, March 27, 2017 I will be forced to file a suit in Small Claims Court.

Message from Claimant: Termination of all business between us. No monetary claim on my part as long as they do not force me to go to a Small Claims Court. If no response by June 2 I will be filing my claim in Small Claims Court for monetary settlement and to terminate our relationship.
