Statement of Claim
Claimant says:
"I have a 2007 Scion tc; I continuously have to add oil or get my oil changed. I was told my car is burning oil and was advised there was a recall for this particular issue. I contacted several Toyota Dealers and was given the run-around until finally one dealership listened to my complaint but by that time I was 2K miles over the warranty milage. I am a college student that is now stuck with the expense of continual oil changes or replacing my engine. I believe a company as large as Toyota should make good on a faulty production regardless of the milage or any other restrictions."

  • Question: by Dave Mueller (181 points) — Retired Since The End Of 2014. I'm A Professional Volunteer And Part-Time Uber Driver.

  • My questions are as follows:

    1. How old was the vehicle when you purchased it? 
    2. How long after did you learn about the recall?  
    3. Did the dealer offer a warranty with the purchase of the vehicle?  

    My only concern is that typically when you purchase a used car with relatively high miles you have no recourse with the seller unless they offered an express warranty when you made the purchase.  If you purchased the car "As Is" with "no warranty" then you have no recourse.  If you have all your maintenance service records, and inquiries documented then it seems the manufacturer should make good on any warranty particularly if the warranty was still in place when you purchased.  However, if you did not maintain the vehicle under the manufacturer's required maintenance schedule than you may be out on your own.  I would have to side with the manufacturer if you were negligent in any way in maintaining the vehicle.
