Statement of Claim
Claimant says:
"Bathroom remodel started July 2015. Last day working on the job December 2015. Last visit by owner/contractor of Sun Design February 23, 2016. Home Advisor has handled the situation without success and have given me what they had. In July 20115, Mr. Stewart said the job would take 2.5 to 3 weeks. The contract signed and money put down for planning. The actual work to begin the first of September. Bathroom torn apart, new shower damaged, 3 week delay. Then one excuse after another. I am on oxygen 24/7. I use a walker a great deal of the time. Since I had to use a potable potty in my bedroom at one end of the house and empty it during the day and use the restroom at the other end of my house I increased the amount of time recovering and number of pain pills each day. Having to find place to take a shower wore me out. Trying to take all I needed into a FRIEND OR RELATIVES shower. Driving elsewhere and then coming home to get ready for a luncheon or dinner engagement. I had to cancel Thanksgiving and Christmas family gatherings at my house. The shower is too narrow and there are no shower doors as was contracted. There is water for me to wipe up most of the time The shower has damage that only the workers could have caused. The toilet isn't as tall as I expected and they hauled off my old toilet after I told them I was not happy. I have no warrenties, product names, guarantees, instructions, Shower sales people did not sell to me and will not discuss any replacement. There are no doors on the linen cabinet. The light switch was put in but the position does not leave room for switch cover. There is so much more. The extra base board, flooring, they took with them. The vanity door and drawer fronts do not line up. The is a gap above the blank panel in front of the sink. That piece is down front the counter top because the door fronts were/are too short. This are not the cabinet design I said I wanted. I have already had the room painted again $400.00 Needed towel bars and grab bars put in.
The last time Mr. Stewart was here, He agreed to do the work, so he knows what needs to be done. He offered and I agreed to a cash settlement on the shower doors and he said he would return my toilet I do think he thought to collect what he was owned according to the contract upon completion. So I see no need to try again. The contractor also has another business.
I, foolishly have paid $17,759.45 and the contract says I owe $4,262.62 upon completion. My bathroom is 5' x 13' long without the cabinets , toilet, and shower."
