Statement of Claim
Claimant says:
"took advantage of 2 disabled veterans... they will not fix my house, instead they point fingers to the 3rd party. house is unlevel, with rolling hills. closets are incomplete, bathtubs were left uncaulked, trim and base look as if kindergarteners installed them , left multiple messages with no one returning them. very unprofessional, eletrical not grounded"

  • Modular Homes of Texas does not warranty the home. Melissa Joyner purchased her home from Modular Homes of Texas. The home was built by Champion Homes (Athens Park Homes). They are the builder and they cover any defects with the home for 1year after purchase.

    Modular Homes of Texas has known of these issues and have tried everything we can to get them resolved for Mrs. Joyner. We have hired an engineer to inspect the home. The engineer has found there was an issue with the floors and that the builder (Athens Park Homes) needed to fix.

    We will help with anything we can but this People's Claim needs to go to Champion Homes (Athens Park Homes).

  • Athens homes has stated that since they did not install the floors, the cabinets, the drywall, that they are not responsible. there are still cracks in the wall that have been there since day 1. there are gaps on the outside of the house which we have had to replace and repair multiple pieces of. The french doors never were repaired. There were multiple promises stating that Modular homes would come out to fix the "minor" issues when the floor was fixed. each technician that has come to look at the floor has stated that the floor needs to be completely removed to fix the issues. that has not been done.

  • If you read the engineer report it states that the floor issue is on the builder. Yes Modular Homes of Texas installed the flooring but the floor needs to be fixed. It can be done under the home or above. If above then it falls on Athens Park homes to have flooring removed and installed. They have done this before with the same issue.
    As for cracks, yes I Kevin Curtis said we would come out to repair. If you read the warranty in the book that you were given it goes over a 30day repair list. We have been out different times and have fixed things for you. Again I'm sorry you cant get the building center to respond. This is why I've have told you to get an attorney. They are responsible not us.

    Inside cracks and outside shifting is due to home settling. Then engineer went over this with you and gave you suggestions.

  • While the flooring can be fixed either under of above in some locations, it can not in all. There were several pieces that were cut too short. Other pieces are fitted in too tight and are buckling up. Athens home has stated that they would not and it on the installers. While people did come out to "repair" the issues identified on the 30 day report, they left before the job was completed. If they had completed the repairs, then I would not have had to caulked my own bathtub or kitchen sink. There is still plenty of trim and base that needs to be caulked and is crooked- some are sticking out an inch past the rest of the trim. The outside is due to the inch gap left in the corners. We had to nail down several wall items outside becasue they were not. Several of the initial cracks were never repaired- I do not have any new cracks in the wall since the initial 30 day reair list.

  • Now that the subfloor is fixed by the builder. Humps in the floor now as I have stated before more than happy to come out and repair cracks, repair baseboard and fix pieces of flooring.
    Is this what you want. None of these items needed to be repaired until the subfloor issue was fixed.

  • the subfloor is NOT fixed. THere are still multiple areas that Athens would not fix. THey only authorized the person to fix 4 areas. I am still walking over hills. THere are places that are 2 inches too short and other places that dip. There are places that bounce and places that crooked. It is so unlevel that my tun and shower have cracked. The technician who came out stated that the whole floor needed to be ripped out because it was that bad. Additionally, he went through most of the spare flooring that was left over. I want everything to be fixed and not half-assed. I do not want broken promises. I should not have had to caulk the bathtub or had to recaulk the sink. As it is, I will most likely have to replace the kitchen countertops this year.

  • Ok, I understand your frustration. I was told the floor had been fixed. I now just got back into the office and see you have added them to the claim. Good, they are the ones that need to be on this not Modular Homes of Texas. We did not build or warranty the home. Once the floors get fixed, I have told you I will be more than happy to send someone out to fix the areas of the flooring, the baseboards and cracks. The subfloor has to be fixed first. Again, I'm very sorry you have had to go through this. I know the floors have been a issue from day one. I will do whatever I can to help.

  • While I understand that you are trying to deflate the issue at hand, the lack of communication and the circle that we keep dancing is inexcusable. I have left numerous messages at the office and have tried to call you multiple times. I even sent emails. This has been going on for 2 years and it is very unprofessional from all parties. I do understand that one thing has to happen before the other and I was very patient. It was your people that came and installed the floors and put the house together. I should not have to get a contractor to repair all the problems and incompleteness of the original build. An electrician had to come out and repair the electrical work because there was no grounding. Most of our outlets were not getting electricity. Our windows leak air and during winter the cold air comes inside. We had to replace the AC temperature control monitor and I have had to get all of our appliances that were "brand new" worked on. Of course, that took time, to where we were out the stove and an oven for over a month. I should not be having these issues with a brand new house.

  • I hear the building center Champion Homes has called our office and is getting ready to respond to you. I hope they will do what's right and repair all issues you have been having. As I have stated many times, Modular Homes of Texas will be more than happy to send someone out to repair any pieces of the flooring that was installed incorrectly. We will also be more than happy to repair cracks in your home due to your home settling. All subfloor needs to be repaired in order for us to fix flooring.

"Have you had an independent engineer look at this? I would be more concerned that significant structural defects may cause problems further down the road. A little settling is not abnormal but if there are foundational problems causing the cracks, then a world of hurt could be ahead."
