Really this is two separate issues: safety and value.
You should file a complaint with the NHTSA, plus contact safety organizations about the problem with the Hyundai Tucson.
You should file a complaint with your attorney general about what you perceive as a forced sale rip-off.
You should contact auto news blogs about the fact that your Tucson lost 25% of its value in less than a year.
I will follow up to see what the results of those actions are if you will add them as you get them.
Did you sign a contract for the trade-in? Maybe I'm confused but it sounds as if:
a) You had a problem with a new Hyundai Tucson that the dealership couldn't duplicate or identify, so they called Hyundai Technical Support which is aware of the problem...but has no current fix.
b) You didn't want to risk driving the car, so the dealership took it back when it was about 9 months old and traded it in for a brand new car.
I'd think the transaction would have been on paper, with signatures all round? However, on reflection, you now feel as if the transaction was unfair?
My comments:
The Hyundai Tucson would have lost value during that time, although if it had lost some 25% of its value, I'd think that Hyundai ought to be concerned and mortified. Really? Does Edmunds.com know about this?!
With a potential major problem in the Hyundai Tucson, I'd have expected more concern from Hyundai's HQ. Stalling out is a serious and potentially dangerous issue. There have been multiple highly-publicized stories about auto manufacturers failing to properly warn consumers and deal with problems.
If there's another side to the story I'd be interested in reading it, but as it is, with the information given, I'd sympathize with the claimant wanting no part of their Tucson. Driving is dangerous enough without technical problems in a new car.
