Statement of Claim
Claimant says:
"I purchased a LG PHONE on NOV 22, 2014 AT $579.99 without including the taxes from an Authorized AT&T STORE. I have not even paid the phone off yet, I am retired and am on a very strict budget. Well, in early November 12, 2016, my cell phone crashed and was at an ATT store and talk with a manager who was named James at phone number I believe was 888-562-8662. Anyway, He asked me what my problem was with phone I told him it crashed and after I named some symptoms he stated it was a known defect with the LG phones that it was a "BOOT-LOOP connection issue and that I should contact LG Repair and they should fix it for me. I called them and got a long email process and then I learned my phone model was not listed and they stated it was because the phone was out of warranty. The phone was not damaged and it crashed from a known defect that another AT& T corporate office in Hanover Md told me and their technical representatives Edwin told me that he gets alot of complaints and the LG phones models (ie., 3 4) have this known defect and they are putting out their new model LG phone would I buy one since I had my phone for 23 months it was probably time for a new one!. I stated that I have not even paid off my current $600.00 phone yet and that they should honor or work out a solution for customers since this is a defect in the phone itself. There are lemon laws with cars why not phones? Anyway, I called LG office and they would not even give me their corporate office address to write a letter, they gave me bogus names like, "SHY" and "Jam "as their services representatives. They were of no help except to acknowledge that the phone does have this defect and then offered me no assistance at all and would not even bring a manager on phone when I requested it!!!!!! I cannot beleive that this comapny is doing business in US and making millions of dollars and they cannot even provide their corporate address. That is a sham.......of the highest order. I have called my Senator's office in Maryland regarding this and let them know of this outrageous practice....They are allowed to do business here and take our money and do not even provide us their public address when asked by the customer."

The claimant's settlement terms were rejected with the following explanation:
  • "As previously stated, that the customer’s device is not a model affected by the boot loop issue. We apologize if the customer is having issues with her out of warranty device, however, we would be unable to offer in warranty service for her complaint. If the customer would like to move forward with repair, she would bear the full cost."
