  • I am sorry to hear that you are going through bankruptcy. My son went through that but knew that was going to be the recourse months ahead. Maybe you could have been forthright and told me about the bankruptcy rather than make empty promises on several occasions that the check was in the mail. I have spoken and emailed you numerous times about this money you owe me ever since you wrote me a post dated check for a week ahead only to stop pay on it after I had already deposited it. You blamed it on the US Post Office for shorting your paycheck. You then promised me on at least two occasions to mail another check. In your latest email regarding a check you said you would send two weekends ago, you asked me if I wanted you to stop pay on it and send a cashier's check via FedEx. I agreed with that (as mentioned above) but still nothing has come. Your emails all acknowledge that I am owed this money. You have had the beef I sold you since the end of May and now you ask me to wait another month!? I did not want to resort to this action but you left me no choice as your promises are empty at best. How am I suppose to accept that any future promise, to include "til the end of August", will be anything but just as unfulfilled? I spite of the times you have emailed me, and sent me deposits over the last two years, I can not fathom that you sent an email to someone else's address when you were back home for a funeral, since I never received it, and now a check that never arrived at an address you have sent correspondence to previously but you say someone else cashed in spite of the fact that we had agreed you would stop pay on it. Based on this fact how can you say "the $415 I 'thought' I had paid you"? You appear to be threatening me in this public forum to agree to either wait until the end of August or be forced to wait in the bankruptcy line. Neither recourse is agreeable to me.

    I will be sending another invoice with the interest accrual indicated if the outstanding debt is not paid within stated timeframes. As this drags on there are going to be other fees that I will also be asking for reimbursement. At present there is $400 from a check you posted dated then stopped pay on that cost me $12 in bank fees. In addition there is the $8 to file this via People Claim. If not paid in a reasonable time (August 10) additional fees may apply.

    Would it resolve this dispute if the owner paid you in product at their wholesale rate? I'm not seeing anything under the original "claimant's opinion" section so its unclear if this was for a one time order- like catering or if claimant is/was on going customer like a restaurant owner etc? More...
