Statement of Claim
Claimant says:
"My name is duy duc le and i work as a nail technician. My wife and I went to see ms whitney, the owner of cielo nails spa in suwanee for a brief interview on july 5th. I told her that we did not have license because of my working schedule and we had a little baby so we work full time. That's why it took forever for us to finish our license. Despite the fact, ms whitney still accept us as full time worker and we began working on tuesday, july 7th. I worked at cielo nails spa for 10 days. During these 10 days, many unfair thing happened to me and my wife. However, one incident happened on friday july, 17th which made us leave. They mistreated my wife saying she have to do the man even though she already told the owner that she don't service man. She yelled at my wife and told her that its her fault that she lost customers and profit. So my wife called the owner back and told her that we are just gonna quit. We asked her when she can give us the paycheck and she said either Tuesday or wenesday. We tried to contact her because the way she said was so unclear but she never answer us until i called the salon on tuesday morning. Then she told me to come on wednesday at 5pm. So on wednesday i came up there and she said she dont have it yet.she have to go through the person handling her bank account and they have to give her the permission to give me the check then She said she have to wait for her boyfriend come up here. i dont see what her boyfriend got to do with my paycheck. Also after that she said i shouldn't get paid any ways cause i don't have license,but when she interview me and my wife we already told her we don't have it and she still said okay cause she have one person in there don't have license too. During 10 days working there, ms whitney had me doing her mom, her sister, her friends and other customer all through them ten days and we agree that we would get 60% of what we made. im suppose to get 1000 and my wife 1100. She also said i shouldn't get paid because i didn't give no notice. When we started this job, we did not agree on any contract or terms that i need to give her notice in advance or she did not mention on any conditions for us to not get paid if we leave early. If she said we should not get paid since we dont have no license, then i supposed she did not pay the non license worker who also worked at the shop either. Plus, there was a lady with no license who started on the same day with us but quit after 7 days working. My wife and i worked full time to take care of our 2 years old baby and pay bills. We had nobody to depend on. Today is my baby birthday, july 27th. Because of this missing payment, we could not do anything for our baby today because we had nothing in our bank and i feel really bad about it as a parent.i work hard for my money i don't ask for no help from nobody no food stamp no welfare i just work and take care of everything myself. Ms whitney of cielo nails spa don't know about hard work. she's barely at the shop. She do not work on customers so apparently she don't know how it feel to work and not get paidsince she don't have no nothing much to worry about. I Haven't missed a paycheck everywhere i work i come here and work i lose my time and money and so much stress. i could lose my car because of late payment but she doesn't care. My wife asked her on the july 16th that when we get paid because normally, we get paid at 16th and the 1st of every months and my bill due on 18th. My wife asked if we can get paid on the 16th so we could pay bills but she just shake her head coldly. We did not ask her to pay us more than what we made. We just asked her to pay the money that we made from July 7th till July 16th but seemed like it's impossible to do so. It shows that she did not care about her workers. i have a family to feed and take care of. I don't know what would happen if i still work there prolly homeless cuz i would've never got paid i have a daughter birthday today but apparently i cant get her anything because i barely have enough for my bills.I'm not asking anybody to pay my bill i just want my money. i work so i can pay it. this is not right. she getting 100% of what i made so I'm guessing she not gonna file tax for that.i pay tax every year. her shop only been there one year. she thought she could take advantage of us cause we didn't have license. Yes, we may not have license but we worked and we pay taxes every years.i have record of me working and checks coming in every two weeks until i came to work for cielo nail spa.I live in stone mountain so take me 1 hour to get there and one hour back to pick up my daughter all the time and gas i wasted working there this is not just affecting me but my whole family.i never gone through this before so this so stressful not knowing how to pay my bills when its the end of the month rent is due."
