Statement of Claim
Claimant says:
"I commissioned Dr. Singh to make a upper denture and a lower bridge. The upper denture and lower bridge were ill constructed. I found during this whole fiasco Dr. Singh was rude and sloppy, leaving the impression material all over my face each time he created one. I found him to be mean-spirited whenever I had to go through this process of try-ons. He roughly stretched my face, and used oversize rubber gloves, sloshing water all over my face each time. In addition, he told me "no talking", as though I were a child, when I was exchanging words with the person who accompanied me, while he was over on the counter mixing, or preparing the denture materials.

This demeanor was not evident upon my first visit. Although I thought it was odd that he had asked me how long I had a heart problem, which I had not indicated on the form that I was required to fill out. His assistant corrected the situation by explaining that the print was small. He immediately became friendly and recounted how he was the head dentist at Montefiore Hospital, and left the practice because he had to train a "white" colleague and the colleague was given a promotion over him. He then added, that is how they do people of color, in an effort to identify with me, as a African American, although he is of East Indian heritage. It was also alarming that I was just given a register receipt and when I asked for a breakdown of the work and cost agreed upon, and balances after each payment, he said he did not give out any invoices. The work had already been started, so I insisted that I have some record of payments. I was begrudgingly given a breakdown on his prescription pad.

This is when his unprofessional and mean spirited behavior began. He also strung out his services, not completing his work in a timely fashion, which allowed the ink on the payment receipts to disappear over the course of the 8 month period he took to present me with his shoddy work. I managed to capture some of the receipt on a copier machine to substantiate this, but luckily I also have my credit card statement and my FSA payment to Dr. Singh.

Once completed the bridge was forced into my mouth. They were very tight and uncomfortable. The upper denture was still lop-sided and gave me blisters at the roof of my mouth when I tried to bite on a sandwich. The teeth were so dull they would not cut through the soft bread. They were so painful. When I tried to remove the bridge, I had to rock it back and forth to prevent it from pulling out my real teeth.
Another dentist evaluated the denture and bridge, and said it was poorly constructed and should be re-done. He wrote his recommendations on his letterhead.

I would like the full cost of the Denture and Bridge to be refunded to me. Dr. Singh has already told me he doesn't give refunds. I paid him $2,300.00 for denture and a bridge I cannot use. I was also told previously, to discuss with his lab tech any issues I was going to have once the work was given to me. I did not employ the Lab Technician. I thought it was the dentist's obligation to assess what was going on with the teeth and instruct his lab tech accordingly.

When I returned to his office to discuss this issue, the lab tech was sitting there and starting arguing about the work, stating I had approved it. I approved a try on that was also not functional because it was in wax, and was told by Dr. Singh that the finals would be "perfect". When I explained to this lab tech that another dentist had evaluated the dentures that were made and found them to be shoddy work, he became belligerent and said “ what does he know, he is only a dentist”.
