Additional Communication Between Claimant and Northwest Fence Hide

  • No one met with me and showed me where fence was going to be located. It was common knowledge that it was to be replaced where old fence had been. I did approach finish men (if that is what they are called) They were very hard workers! I told them I would not accept the fence being short of where the old one had been. They brought up a small section and they suggested it be put at an angle. They would probably had to cut off a foot to put it straight as there is a electrical box on the ground there. It would have been more work to cut it off so they recommended putting it at an angle to save more time and labor. I told them that I didn/t plan on paying for that section as the new fence had come short of where the old fence had been. No one talked to me, Colon said he talked to me but he did not. Why was the new fence measured short? I did not and am not asking for a cash settlement, I just want a zero balance. Colon knows he did not talk to me about it and I did not approve it or you would have a signature. I only asked for and approved the piece to cover dead trees that looked into my yard. I can not help it was measured incorrectly. I did not say I want to pay for 4 more feet that was measured short. You can come and look where old fence had been. You may straighten out section you put in and cut it off to where old fence was, but new fence shud have ended where old one had been.

The claimant's settlement terms were rejected with the following explanation:

    "4/15/14 Contracted with Dottie Higgins

    5/6/14 Post Set Foreman met with customer. Identified layout to replace fence in same location as fence removed. Area in question is indicated as approximately 24' on the west property line that extends in the same alignment as the backyard fence. See attached labeled as Original.

    5/19/14 Finished all fence with the exception of the gates which were not ready. At this time the customer made a request to our Finish Foreman to add one more section of fence at approximately a 45 degree angle at the end of the 24 foot line shown on the original bid.

    5/20/14 Finish Foreman turned in customer request for fore mentioned change. Northwest Fence Salesman contacted customer indicating the cost of the requested change, Dottie Higgins gave instruction to proceed. See attached labeled "As Built"

    5/22/14 Gates were hung. Requested change order work completed.

    Northwest Fence rejects request for cash settlement.
    Northwest Fence will not issue a letter of apology for attempting to collect payment for work completed as instructed by Dottie Higgins.

    If payment in full is not received by 9/12/14, Northwest Fence will assign this account to collections."
