"My dispute is with two parties – ASHLEY FURNITURE INDUSTRIES, INC. 1601 Ashley Way; Colten , Ca. 92324 and MICHAEL’S FURNITURE WAREHOUSE-7700 Woodman Ave.: Van Nuys, Ca. 91402-6527
I have physical evidence via registered letters, emails, invoices, pictures , etc., which I feel will help this case if it were in your possession. Enclosed are images of the defect /damaged couch , cushions , mechanism hinge , and the $30 couch cover I had to purchase to hide the problem from view.
I purchased ONLINE( at MICHAEL’S FURNITURE WAREHOUSE website -a distributor of ASHLEY FURNITURE), a $795.00 (plus tax and $80 delivery) faux leather sleeper-sofa couch . Customer Sku. # RP ITEM M15021C- Ashley sku. # 100-96 -PQ# 81686 AUSTIN -MFO ACK ORDER # C846464- SSCC: (00) 0 0024052 048109137 4
The sleeper- sofa couch would not lie flat when open in the sleeping position. I asked the delivery /assembly person to fix the issue. He said he could not fix it.
I contacted the manufacturer of the sleeper mechanism (ASHLEY FURNITURE) to ask if this 18” elevation at the head of the bed was normal. They said “NO”. The end of the bed was elevated by 15” ( ‘sleeping in a taco’ effect).
ASHLEY FURNITURE said it was MICHAEL’S FURNITURE WAREHOUSE who was at fault for incorrect installation.
I immediately contacted MICHAEL’S FURNITURE WAREHOUSE to complain.
[They WAITED to contact me until I could not get a refund via my CHASE CREDIT/DEBIT CARD knowing the time limit for returns]
At first, they said that was what the display bed did (‘taco effect’) at their store and that it was normal.
( When I originally looked at the NOW DISCONTINUED sleeper –sofa COUCH at their warehouse a year before ordering , there were no sleeper-sofa mechanisms in any of their couches anywhere in the store to lie on or even look at.)
I was not satisfied with MICHAEL’S FURNITURE WAREHOUSE’s response, so…
On July 22, 2012, They sent a VERY RUDE/HOSTILE repairman, who said the elevation (‘taco effect’) was normal and that he could not fix it. He said this time it was not his fault, that THE SLEEPER MECHANISM DID NOT FIT the sofa; I do not know what he meant about it not being his fault unless he had installed one wrong before and been confronted over it. All I know is that he was very angry about it when he arrived, because THIS PROBLEM HAD HAPPENED to MICHAEL’S FURNITURE WAREHOUSE BEFORE according to him. His name is GERARTO BARAJE 626 536 8618.
He left a copy of the WORK ORDER saying UN-REPAIRABLE.
MICHAEL’S FURNITURE WAREHOUSE said I would have to contact ASHLEY FURNITURE since it was a manufacture’s DEFECT.
Since then, The HINGE MECHANISM the repairman said was not repairable, BROKE and RIPPED A HUGE GASH IN MY CARPET making the bed IMPOSSIBLE TO CLOSE except under EXTREME FORCE; the CUSHIONS AND COUCH UPHOLSTERY FAUX LEATHER began to PEEL/ DISINTEGRATE.

3 Year Limited Warranty
Ashley Furniture Industries, Inc. warrants to you, the original retail purchaser, all mechanisms used in sleepers for three years from the date of purchase, to be free from material manufacturing defects. Ashley Furniture Industries, Inc. will pay, within one year from the date of purchase, reasonable and customary labor rates to repair or replace the defective parts and shipping costs from the retailer to and from Ashley Furniture Industries, Inc., or a repair center designated by the Customer Service Department of Ashley Furniture Industries, Inc., at no charge to the original retail purchaser. After one year from the date of purchase, the sleeper mechanism warranty covers replacement parts only, and the original retail purchaser will be responsible for labor, packing, and all shipping and transportation costs.
I contacted ASHLEY FURNITURE again. I have the email from ASHLEY FURNITURE stating it is MICHAEL’S FURNITURE WAREHOUSE’s responsibility. The date was June 24, 2014
On June 30, 2014, I wrote a letter the C.E.O of Ashley Furniture – TODD WANEK- complaining about how I had been treated and the problems I have had with their product. I have a copy of the letter where his representative stated it was not their problem even though I had enclosed a copy of THEIR THREE YEAR WARANTEE.
I then emailed MICHAEL’S FURNITURE WAREHOUSE to try to resolve this issue again; they claimed it was past the ONE YEAR warrantee . Again, The letter to ASHLEY FURNITURE has a copy of the THREE YEAR WARRANTY printed in it.
This couch has been DISCONTINUED.
I will accept money to replace my couch, (OF EQUAL or BETTER VALUE since the prices may have gone up since I purchased this one).
I will not accept a faux leather covered couch because it peeled/DISINTEGRATED in a short time, although it had been treated with gentle care.
I also want tax and delivery covered , the removal of this damaged couch from my West Hollywood, Ca. location , plus the damage to my carpet repaired or replaced.
If there is a fee for this service to expedite my case, please send me a preferred payment method. I do have Paypal as well.
