Claimant says:
"On Monday, June 23, 2014 at approximately 6:25 pm the "Resident Only Exit Gate" at the Lake Lanier Club Apartments closed on my vehicle causing approximately $1150 - $1200 worth of damages.
My first claim against Lake Lanier Club is for "Breach of Contract." Failure to safely maintain fixtures.
My second claim against Lake Lanier Club is for "Negligence." For not exercising a duty of care, causing a accident, resulting from a failure to utilize proper lock-out or tag-out procedures.
My third claim against Lake Lanier Club is for "Failure to Communicate." For failure to communicate and warn the people about terrible danger they were in.
The repairs will require approximately (3) to (5) days to be made. Costing about $630 for a rental vehicle.
Lake Lanier Club's position: "We are not liable to any resident for automobile access gates." My position: You are when you have shown to be "Negligent."
Lake Lanier Club's position: "The exit gate was locked out."
My position: The exit gate was not properly locked out, and was still functioning after the incident, and after the Gainesville Police Officer arrived on the scene."
