Statement of Claim
Claimant says:
"they came to fix a leaking tub, they came and checked the basement ceiling they said we need a new part to fix the leak, a couple days later they brought the part and replaced it, when they replaced the drain they cracked and chipped the tub, the worker said sorry and covered it with silicone, a couple days later all the silicone come off, i went to the basement and the ceiling and the tub was still leaking into the basement, i called them again and told them what happened, and the owner came and he blamed it on the tub being old then he called someone, he was a rebath person, the rebath would cost $500, the owner of the company refused to take any responsibility for what happened and said the cost was all on me, i told them i dont want to have to pay for it myself because they caused the damage, he came back a couple days later, he covered the cracks and chips with apoxy, but that too came up, they havent responded to any of my calls and sent me a bill for $245, he said the chips and cracks were already there even though his worker apologized for them, i dont feel i should be responsible for all the cost of the rebath or the bill for the repairs since they caused more damage then they fixed"

  • We were called out on June 2 for a tub leaking into the basement. The service technician pointed out chips in the tub to you before we even started working. We diagnosed the problem with the waste and overflow on the tub The part is old and we were not able to get the exact replacement so we ordered in a universal part. We made the repairs June 4. You called back 9 days later and did not like how we had to silicone the part in and also stated we chipped the tub. The owner was sent over to look at problem, he also brought along a professional refinisher so he could look at repairs needed. The refinisher quoted a price of $30.00 to repair the chip we made at the waste and overflow and tried to set up a time to repair. He also stated there were other chips in the tub that were there for some time due to the discoloration around them. He said the cost would be more if she wanted to refinish the entire tub (approximately $500.00). While on site at this time, she did not like how we did the piping the first time and wanted it redone. It was done at no cost to her a second time. I would be happy to submit a copy of the bill showing the charges and the work we did at no cost. I spoke to Ms. Battin on June 29, she would like the whole tub refinished at our expense. We made the chip by the waste and overflow, not all the other chips. I would be happy to be present if she would like to call in another refinisher to look at her project.

    will not allow me to attach a copy of the bill, is there another way to do this?

  • This is the 3rd time I have typed this in my allotted space, it disappears when I get ready to send. Will anyone respond to my letter of August 11? I still cannot attach my documentation of the bill sent to her, with the labor and material not charged to her. I have rejected her offer in repairing all the chips in her tub. I will gladly pay to have the chip we made repaired at my expense. I do support that this gets resolved.

  • There was no damage before your employee started working on the tub, and i didnt expect you pay for the whole but to cover some of the repair cost.
