Statement of Claim
Claimant says:
"I used convenience checks issued by Bank of America Credit Card Services . The person that I wrote the check in amount 1700 $ whom made a mistake while depositing check and check was swollen by ATM machine . We called to his bank and asked about this problem , the bank told it will take up to 2 weeks to get money . So I called to Bank of America and ask them to cancel this check ,so I can wright him a new check . They told me that it's impossible to cancel check but I can do stop payment on this check it will cost me 10$ . I agreed to payment and gave them over the phone all information to do stop payment including : 1 check number that was given , 2. Person Name and his account number in other bank.
I was confirmed that they did stop payment on the check that was swollen by ATM.
After I did stop payment on this check I wrote second check to this person in amount 2035$ for his job as a painter to paint my home.
After approximately. a month on May 9, 2014 . I noted that check that I did stop payment came out of my account . I called immediately to Bank of America and asked them what happened why check came out of my account . They couldn't tell me any explanation as how this happened .
I requested to reverse payment it was only 2 or 3 business day when check came out of my account they told me that I will receive credit for amount of 1697 $ ( amount of the check ) 3 $ was debited from check when painter was trying to deposit check in ATM.
After month and a few phone calls I received check in the mail in amount of 1697$ , when I checked my credit card balance it increased by 1697 ? So I again called to bank and told that it's looks like they did cash advance from my credit card by I requested a refund not cash advance . The Bank of America told me not to deposit check and they put money back to my credit card . Indeed on June 19 the balance decreased back to initial amount of 3735 $ , again I was told that was a mistake and other person did cash advance instead of refund . I ask them about refund it will take a 2 weeks we need to check that check you received was not used .... after a 3 month I went to local branch bank of America and fille out complaint . I was told over phone they will post refund in a few business days
Nothing happened I wrought a complaint latter . Again called multiple times after working nights they was constantly telling me you already received refund because cash advance they put back on my credit card . Finally a 2weeks ago I was told that they can not process refund because money already came out of my account and I need to talk to person that I gave convenience check .It's a joke ??
I was extremely upset and told them that will go to court to resolve this issue .They only returned me 10$ fee for stop payment denying a fact that was a stop payment on this check that came out of my account"
